These terms apply to every order placed on this website. Please read them — particularly the sections on permitted use and age, which are not boilerplate for this product.
1. Who we are
BuyPrimeWhip (“we”, “us”).
We trade only online. Orders are placed through this website and delivered by carrier; we operate no retail premises, so there is no collection option and nothing on this site is an offer to supply in person.
You can reach us by the means set out on our contact page, which is also where our registered address and telephone number appear.
2. Permitted use — culinary only
Everything sold here is food-grade nitrous oxide and related equipment, supplied for preparing food and drink only. By ordering, you confirm you are buying it for that purpose. Nitrous oxide must never be inhaled. We may refuse or cancel any order where the evident purpose is inhalation, and we may do so after taking payment, in which case we refund in full. 3. Age
You must be 18 or over to order. See our age policy.
4. Orders
Your order is an offer to buy. A contract is formed when we confirm dispatch, not when you place the order or pay. We may decline an order — for example where stock is unavailable, where we cannot ship to the address, where a price is clearly wrong, or under sections 2 or 3 above.
5. Prices
Prices are in CAD and exclude sales tax, which is added at checkout. We may change prices at any time, but not after we have confirmed your order. Where a price is obviously incorrect we will contact you before dispatching rather than simply charging it.
6. Delivery
Delivery terms and restrictions are set out on the delivery page. Transit times given anywhere on this site are estimates from the carrier, not guarantees, unless we have confirmed otherwise in writing for your specific order.
7. Returns
See returns and refunds. Pressurised goods that have been connected or part-used cannot be returned.
8. Product information
Specifications, fill weights and purity figures are as stated by the manufacturer. We reproduce them in good faith and do not independently test them. Photographs are representative; packaging and labelling change from time to time.
9. Safety and your responsibility
You are responsible for using the correct regulator and equipment, for storing cylinders safely, and for following the handling guidance on the safety page. We are not liable for loss or damage caused by misuse, by use with incompatible equipment, or by use contrary to these terms.
10. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or your rights under applicable consumer protection legislation. Subject to that, our liability for any order is limited to the amount you paid for it.
11. Privacy
How we handle your information is set out in our privacy policy.
12. Governing law
These terms are governed by the laws of Canada and the federal laws of Canada that apply there, and the courts of Canada have jurisdiction.
This does not take away the protection of the consumer legislation of the province you live in. Where that legislation gives you a right we cannot contract out of — and several provinces do, particularly for contracts formed online — that right applies regardless of this section.
13. Changes
We may update these terms. The version that applies to your order is the one published when you placed it.
